Terms of Service

These Terms of Service ("Terms") cover the website, digital marketing, social media and other services provided by The Firm Advertising Agency, Inc. ("The Firm," "we," "us"), and your use of thefirmfl.com. By signing up for a plan, buying a website package or using our website, you agree to these Terms. If we have a signed proposal or agreement with you, that document controls where it differs from these Terms.

Monthly plans

  • Monthly plans are billed in advance, once a month. There are no setup fees on monthly plans.
  • Monthly plans have a 3-month minimum. After that, your plan continues month to month until you cancel.
  • You can upgrade anytime. Downgrades take effect at the next billing cycle.
  • Spark is available only to registered 501(c)(3) nonprofits. Google sets the eligibility rules and limits for the Google Ad Grant.

Website packages

  • Website packages are one-time fees. Current prices, and the discounts available when you pair a site with a monthly plan, are listed on our Pricing page.
  • The 7-day timeline for a 7-Day Launch Site starts when you finish your online intake (logo, photos, logins and goals). If we are waiting on content or approvals from you, the launch date moves by the same number of days. Other packages follow the timeline listed for them.

Advertising

  • Ad spend is not included in our fees. You pay Google, Meta, LinkedIn or other ad platforms directly, so you always see exactly what was spent.
  • Surge includes managing up to $5,000 a month in ad spend. Above that, management is 12% of spend.
  • Ad platforms set their own policies, approvals and prices. We cannot guarantee that an ad will be approved or will perform a certain way.

Payments

  • Payments are processed by QuickBooks (Intuit). We do not store your card or bank details.
  • If a payment is late or fails, we may pause work until your account is current.

Cancellation and refunds

  • After your 3-month minimum, you can cancel anytime with 30 days' notice by emailing PowerUp@TheFirmFL.com.
  • If your website was discounted or included free because you chose a 6- or 12-month plan, and you cancel before that plan term ends, the rest of the regular website price, minus anything you already paid toward it, is due when you cancel.
  • Fees already paid are not refundable, except as stated in your proposal or agreement or as required by law.

What we need from you

  • Accurate information, timely feedback and approvals, and access to the accounts we need to do the work.
  • Materials you have the right to use. When you send us logos, photos, text or other materials, you confirm you have permission to use them and allow us to use them for your services.
  • Final say on facts. You are responsible for the accuracy of prices, offers and claims about your business, and for following the laws and platform rules that apply to it.

AI-powered, human-led

We use AI tools trained on your brand to help draft, monitor, schedule and report. A member of our team reviews and approves the work before it goes out. Please do not send us sensitive personal information, such as health, financial account or government ID details, through our forms.

Results

We work hard to grow your visibility and leads, but we cannot guarantee specific rankings, traffic, AI search mentions, leads or sales. Search engines, AI tools, social platforms and ad platforms change often and are outside our control. Results shown on our website come from specific past clients and are not a promise of future results.

Ownership and portfolio

  • You keep ownership of the materials you give us.
  • Ownership of website files, designs, domains and ad or social media accounts is set out in your proposal or agreement.
  • Unless you ask us not to, we may show your organization's name, logo and public work in our portfolio.

Confidentiality

We keep your non-public business information confidential and use it only to provide our services.

Limitation of liability

To the extent the law allows, The Firm is not liable for indirect damages or lost profits, and our total liability for any claim is limited to the fees you paid us in the 3 months before the claim.

Governing law

These Terms are governed by Florida law. Any dispute will be handled in the courts of Charlotte County, Florida.

Changes to these Terms

We may update these Terms from time to time. The date at the top shows the latest version.
